Terms and Conditions of Use

AGREEMENT: By ordering any product from RECHEMICALS, I, as Purchaser and/or End User, agree to provide true and correct information as required and to read and understand all statements and portions of this total contract and agree to abide by all of the terms and conditions as stated and to consider them binding under any and all circumstances.

RECHEMICALS POLICY STATEMENT: All products should be handled only by competent, suitably trained persons, familiar with proper laboratory procedures. The burden of safe use of RECHEMICALS products vests in the Purchaser and/ or End User. In purchasing these products, the Purchaser acknowledges that there may be hazards associated with their use. The Purchaser and/or End User assumes all responsibility for warning his employees and any persons who might come into contact with the products, or all risks to person and property in any way connected with the products and for instructing them in their safe handling and use. The Purchaser and/or End User also assumes the responsibility for safe and lawful use and safe and lawful disposal of all products. Purchaser and/or End User represents and warrants that from his/her own independent review and study (s)he is fully aware and knowledgeable about (a) the health and safety hazards associated with the handling of the products purchased; (b) industrial hygiene controls necessary to protect his/her workers from such health and safety hazards; (c) the need to adequately warn of health and safety hazards associated with products; and (d) government regulations regarding the use of and exposure to such products.

The Purchaser and/or End User shall indemnify RECHEMICALS and any of it’s employees or affiliates for and against any and all losses, damages and expenses, including legal fees and other costs of defending any action, that RECHEMICALS may sustain or incur as a result of any act or omission by the Purchaser and or End User, its officers, agents or employees, its successors or assignees, its customers or all other third parties, whether direct, indirect, in connection with the use of any Product.

I DECLARE: that I, as Purchaser and/or End User am trained and qualified in proper laboratory and manufacturing procedures for the products being used and or purchased and that I as Purchaser and/or End User am familiar with potential hazards associated with said Products.

END USER NOT PURCHASER AGREEMENT: I understand and agree that if I am not the End User that it is my responsibility to make known to the end user any and all information related to the MSDS and all other relevant information regarding safe handling and potential hazards associated with purchased product(s).

SAFE USE: Material Safety Data Sheets (MSDS) are required by law for many chemicals. You must maintain them on-site in your laboratory. Purchaser and/or End User agrees to familiarize themselves with the MSDS and product labels and refer to the MSDS and labels for applicable warnings and safe use. RECHEMICALS strongly recommends that Purchasers and/or End Users use this information to ensure proper use and that the health and safety of all are protected. RECHEMICALS furnishes the information on each MSDS without warranty. The Purchaser and/or
End User also assumes the responsibility for the safe disposal of all products in accordance with all applicable laws.

PRODUCT USE: I declare that I understand that the products listed and sold by RECHEMICALS are for research and development purposes only.

NOT FOR IMPROPER USE: I understand and agree that the chemicals sold by RECHEMICALS are not to be used for any other purposes, including but not limited to use as or as components in drugs for human or animal use, medical products or devices, cosmetics, food additives, household chemicals, or explosives, and are not intended for human consumption. I further agree that no RECHEMICALS product will be used in the diagnosis, treatment or mitigation of disease or malady. RECHEMICALS offers no warranty regarding the fitness of any product for a particular purpose and shall not be responsible for any loss or damage whatsoever arising therefrom.

I DECLARE: that I understand that the absence of a warning must not be interpreted as an
indication of safety, as complete information regarding hazards and risks is not available for all research products.

USES AND PATENTS: RECHEMICALS’s materials are offered for laboratory and manufacturing
use only. The listing of a material on this Web Site does not constitute a license to, or a recommendation for, its use in infringement of any patent. RECHEMICALS reserves the right to limit sales of products or not to sell products to unqualified customers.

LIMITED WARRANTIES: The information included on this Web Site has been obtained from normally reliable and dependable sources and is correct to the best of our knowledge; however, we cannot guarantee it as such. RECHEMICALS makes no other representations or warranty of any kind, express or implied, as to merchantability, fitness for particular purpose, or any other matter with respect to our products, whether used alone or in connection with any other substance.

RECHEMICALS RETURNED GOODS STATEMENT: RECHEMICALS will make every effort to ensure that your purchase meets or exceeds expectations with regard to quality, packaging and storage until shipped. If it becomes necessary to return merchandise, please contact RECHEMICALS. Returns must be authorized before being sent back, and must be packaged and shipped in compliance with all applicable laws and regulations. Only items
authorized by ReChemicals for return will be accepted. Final disposition of returned goods will be made only after receipt and inspection of goods.  Materials must be received within 48 hours of receipt. International shipments are not able to be returned. Materials returned requiring disposal may incur additional charges. A 20% restocking fee is charged on all items returned, subject to a minimum charge of $20.00 and a maximum charge of $150.00 (except for bulk orders).

Certain returns are not accepted; including but not limited to: opened, leaking or damaged containers; materials with a shelf life; materials which must be refrigerated; custom or special orders; items with missing or obliterated labels. We only accept returns for packages that were damaged in transit.

Upon the approved return of any such product, RECHEMICALS shall have the option to replace such product with a conforming product or to return the purchase price to customer, at RECHEMICALS’s sole discretion. Purchaser’s exclusive remedy, for any cause or claim whatsoever, including but not limited to alleged breach of warranty, product liability, negligence, or otherwise, shall be for money damages in an amount not to exceed the purchase price paid by purchaser for the product in respect to which the claim is made. In no event shall RECHEMICALS be liable for special, incidental or consequential damages, whether purchaser’s claim in contract, negligence, strict liability or otherwise.

RETURNED GOODS: I agree that returns of RECHEMICALS purchases must be made within 48 hours of receipt. And that the shipping costs of my order are NON REFUNDABLE.

ACCEPTANCE OF RETURNED MERCHANDISE: I declare that I understand that RECHEMICALS will not accept unidentified or unauthorized return shipments or return shipments made without prior authorization and that RECHEMICALS will discard such shipments without reissue of credit to the purchaser.

TAMPERING, SPECIAL AND BULK ORDERS: I declare that I understand that RECHEMICALS will not refund for credit any special order or bulk products or products which have been opened or show signs of possible tampering.

UNDELIVERABLE & RETURNED PACKAGES: In the event that a package is marked as undeliverable and returned to us by the shipping organization, we will treat this package as an authorized returned item. We will refund your order minus a 20% restocking fee and shipping charges. We also reserve the right to deny any future orders from customers who provide us an address for a package that gets returned to us by the shipping organization.

CREDIT CARD CHARGEBACKS/REVERSALS: We reserve the right to provide your complete personal and order details to a collection agency, and/or to the public, in the event that your credit card payment is reversed through no fault of our own and you fail to make good on the reversed payment within 14 days. After 14 days we will publish your information online and have it indexed by Google, ban your account/IP address from our website and any accounts in proximity to yours that may be correlated with you, then submit your details to a collection agency and be done with you.
